食品监管渎职罪是指负有食品监管职责的国家机关工作人员的渎职犯罪。对其增设存在必要性与非必要性之争,关于其罪名设置存在分罪论与合罪说两种不同理论。综合分析,食品监管渎职罪增设具有必要性,在罪名设置上,将食品监管渎职罪分设为食品监管滥用职权罪和食品监管玩忽职守罪更为合理。
