民间文学艺术是我们世世代代所流传下来的非物质文化财富,它是文化的活化石。纵观全球,民间文学艺术在得到了广泛传播的同时,也出现了一些优秀民间文学艺术被盗取和歪曲利用的情况.我国作为一个由五十六个民族组成的多民族国家,民间文学艺术历史悠久、绚丽多彩,然而立法上的种种不完善却使得我国宝贵的民间文学艺术保护缺乏完善的制度保障并屡遭滥用和他国的掠夺。因此,在此种形势下探讨有关我国民间文学艺术的知识产权保护是十分重要也是必须的。

Folk literature and art is the spiritual wealth of human handed down from generation to generation and the living fos-sil of culture.Folk literature and art widely disseminates on a global scale,whereas,there is a situation that some of the best folk literature and art have been stolen and used distortedly.China is a multinational country and has a variety of folk literature and art,but the laws and regulations are very scarce.Therefore,it is very necessary to discuss the protection of intellectual property rights to Chinese folk literature and art.
