The Interests of Economic Law Protection

公共利益,社会利益,社会公共利益在我国法律、法规、规章和规范性文件中频繁出现,但是学界没有明确的界定使得三者在法律使用中出现混乱。本文试从三者的基本语义分析和法律条文中的使用,分析它们的区别,最后得出三者并不是绝对的界分明显,而是只是在不同的领域,不同的学科维护的不同法益。经济法作为一门新兴法律部门,维护的利益体现出一定的综合性,社会公共利益作为其维护的法益,具有特殊性、必然性。

The public interests,social interests and social public interests frequently appear in the law ,the regulations and reg-ulatory documents of our country.But there is no clear definition in the academic,so they are chaotic in the using of law.This article tries to distinguish them from the basic semantic analysis and the use of the law.In the end,we find that there is no abso-lute boundary points between them.They only maintain different legal interests in disparate territories and distinct subjects.As a new legal department,the maintenance of interests of economic law are comprehensive.As its maintaining interests,the social public interests are special and necessary.
