摘要
民族法律规范是我国调整国家内部民族关系的重要方式,历经数十年的发展,我国已经初步形成了较为完善的民族法律体系,并取得了重大成就。但是,目前我国民族法律体系仍然存在着立法空白、法律法规政策化等问题。本文首先对我国民族法律体系的形成历程及其基本构成内容进行概说,再以民族法和法理学角度对其目前面临的问题进行探讨,以期对进一步完善该法律体系提出有益建议。
National laws and regulations are the important way to adjust the country's internal ethnic relations. After decades of development,China's national legal system has begun to improve and has made significant achievements. However,there are still legislative gaps and regulatory policy issues in our national legal system. Firstly,this paper describes the history of the formation of our national legal system and its basic structure content. Secondly,this paper discusses the current issues from the view point of national law and jurisprudencewith a hope to make useful suggestions for improving the national legal system.
