摘要
通过对教育惩戒领域内基础理论的简单论证,和不同国家具体做法的梳理,提出我国未来相关领域立法必须解决的问题,同时在教育惩戒方式、程序和普遍关注的提法问题上,对各国做法进行比较。文章主旨不在于得出结论,而是通过比较启发制度构建方面的思考,即使对似已形成定论的体罚的观点,也主张合理对待。
Through the simple argumentation of the basic theories in the field of education and discipline,and the combing of the specific practices of different countries,the problems that must be solved in the future relevant legislation of China are put forward.At the same time,in the issue of education disciplinary methods,procedures and general concerns,comparison of national practices.The main purpose of the article is not to draw conclusions,but to think about the construction of the heuristic system.Even if it seems to have formed a corporal punishment of the conclusion,it advocates reasonable treatment.
