上海海事法院中国海事仲裁委员会上海分会委托调解机制研究

On delegated mediation program between SMC and CMAC Shanghai

调解作为一种重要的纠纷解决方式,在纠纷处理过程中发挥着越来越重要的作用。以上海市高级人民法院、上海海事法院与中国海事仲裁委员会上海分会之间达成的委托调解机制为背景,介绍此种机制在实践中的具体运作模式、优点及存在的问题。同时,考察其他国家的调解机制,并与本文的委托调解机制进行对比研究。最后讨论委托调解机制中值得进一步探讨的问题,包括适宜调解的案件类型、对恶意当事人的制裁等。

As an important method for disputes resolution,mediation has been played a more and more important role in resolving disputes.Based on the delegated mediation program launched by Shanghai High People’s Court,Shanghai Maritime Court(SMC)and China Maritime Arbitration Commission Shanghai Branch(CMAC Shanghai),operations of such a program in practices,its advantages and problems are introduced.Meanwhile,the thesis mediations in some other countries are analyzed and they are compared with the delegated mediation program.At the end,some aspects of the delegated mediation that need to be further discussed are discussed,including types of cases proper for mediation,sanctions on parties in mala fides,etc.
