诉讼外解决纠纷方式之一的调解,在我国有人民调解、行政调解和司法调解三种形式,它们各自有其解纷的优势和局限性。上海、大连等地尝试着将三种调解方式相结合,构建'三调联动'模式化解社会矛盾。为使'三调联动'在化解社会纷争中的作用最大化,我国应建立专门的'三调联动'机制的领导协调机构,实现三大调解有序衔接和互动,借鉴国内外有益的成功经验,构建多元化纠纷解决机制,尊重当事人的程序选择权。

Mediation,as one approach of dissolving disputes besides litigation,presents itself in three ways,namely people’s mediation,administrative mediation and judicial conciliation,all of which have their own advantages and shortcomings in dissolving disputes.Cities,like Shanghai,Dalian,etc are trying to combine these three mediations to dissolve social disputes.In order to maximize the effects of the mechanism of"Combination of Triple Mediations"in dissolving social disputes,China is advised to set up a leading and coordinating organizations,which help the mechanism of"Combination of Triple Mediations"function coherently,introduce the successful experience from home and abroad,form a diversified mechanism of dispute-dissolving and respect the procedure option of litigants.
