摘要 借力中国提出建设'21世纪海上丝绸之路'的开放大格局,立足推进国际海事司法中心建设过程中法治软环境提升的内生需求,从记名提单货物控制权与提货权这一新视角切入,详尽阐述海运履约方'三方两种法律关系'的要义。在兼顾各方利益的前提下,将货物控制权概念引入海商法律中,为破解海事审判司法实践中热点、难点问题,谋求一项既与国际接轨又具中国特色的立法新思维。 Depended on the opening-up pattern of building the 21 st-Century Maritime Silk Road,based on the international maritime law judicial center of soft environment construction of internal demand,straight bill of lading of cargo control is explicitly elaborated from the perspective of right and the right of taking delivery.The concept of right of cargo control into maritime law are introduced and maritime performing in the process of'three parties and two legal relations'are focused on,aiming at exploring a line with international standards as well as with China characteristics the new legislation thinking.
