摘要
港口惯例在航运发展中具有悠久的历史,适用港口惯例解决矛盾的逻辑和思路仍然值得继承。从港口惯例的定义入手,分析英美法适用港口惯例的规则和要点,并与我国法律背景下港口惯例的适用进行对比参照,最后提出适用港口惯例解决纠纷时的一些思考和建议。
Port customs have a long history in the development of shipping and are worth reference and learning now and forever.The definition of port customs,the rules and application of port customs in common law are analyzed,and the application of port customs under Chinese law are compared,finally the principle,scope and essential points of application of port customs are proposed.
