金融犯罪概念之争

Research on the Definition of Financial Crime

关于金融犯罪的概念,学术界一直存有争议,对其所作的界定,一直是刑事立法在发挥着关键作用。随着刑事立法的变迁,金融犯罪的定义域出现了限缩与扩张两种截然不同的趋势。本文在对各种金融犯罪概念进行解读的基础上,分析刑法所追求的秩序目的,描摹金融犯罪的样貌,并提出结合司法进行金融犯罪界定的观点。

Although there is no conclusion about the concept of financial crime,the criminal legislation plays a key role in defining the concept of financial crime. Along with the change of criminal legislation,the definition of financial crime has two distinct trends,which are limited and expanded. This paper discusses those different concepts,analyzes the order pursued by criminal law order,describes the financial crime's appearance and take criminal justice as an alternative way to defining financial crime.
