时间—空间宰制视角下服刑人员的监狱适应性研究

Research on Prison Adaptability of Prisoners from the Perspective of Time-Space Rule

当前国内学术界对监狱的研究局限于刑罚学视角之下,而在某种程度上忽视了对人的研究,尤其是服刑人员的监狱适应性研究。服刑人员的监狱适应状态不仅表征着监狱惩罚与改造的重要职能,而且作为审视改造成效的重要标准。代表国家权力的监狱与民警通过控制时间与空间对服刑者实施制度化的惩戒、宰制、规训与改造,使服刑者的行动和思维符合监狱管理的秩序规范和价值期待,同时为服刑者留有一定的时间和空间自主性使其保持相应的独立性与自主性,这一过程服刑者经历着顺从、痛苦、冲突、合作与自主等适应形态。可见,基于时间与空间的分析,既可以较为全面地洞悉监狱惩罚和改造的强制性、弥散性与恢复性,也可以了解服刑者监禁痛苦的制度化适应和自我调适的过程。

The prison adaptation of prisoners not only represents the important function of prison punishment and reform,but also serves as an important criterion to examine the effect of reform.Prisons and policemen representing state power institutionalize punishment,rule,discipline and transformation of prisoners by controlling time and space,so that prisoners’actions and thinking conform to prison management norms and value expectations.At the same time,the prisoners should have certain time and space to maintain their corresponding independence and autonomy.In this process,prisoners experience the adaptive forms of obedience,pain,conflict,cooperation and autonomy.Based on the analysis of time and space,we can understand not only the mandatory,diffuse and restorative nature of prison punishment and reform,but also the process of institutionalized adaptation and self-adjustment of prisoners’imprisonment pain.
