摘要
2014年1月1日生效实施的欧盟海关知识产权保护新条例是欧美针对假冒货贸易依然猖獗而不断加强海关知识产权保护的新发展。美国通过制定颁布知识产权执法的国会立法,修改有关海关条例或海关知识产权保护的指南或手册,进一步强化或明确海关知识产权保护。这些新发展使得中国海关知识产权保护面临新的挑战。本文通过评述欧美海关保护知识产权的新发展及其挑战,提出有关应对的建议。
The new EU regulation on Customs protection of intellectual property rights entered into force on 1 January 2014 as the new development to enhance the Customs IP protection in the EU and the US to respond to the increasingly rampant counterfeit goods.The US revised its Customs regulations or the guideline or manuals of Customs IP protection through formulating congressional legislations on IP enforcement,so as to further strengthen or specify the Customs protection of IPR.Those new developments pose new challenges to IP protection of China Customs.This article introduces the new developments of Customs IP protection in the EU and the US with comments focused on challenges and suggested responses.
