摘要
作为中国特色社会主义法律体系的组成部分,海关法律体系的运作历史较为长久且完整。检视我国海关法律体系构建过程中所出现的相应问题,某种程度上也是在进一步探讨我国法律体系存在的部分问题。审慎考察我国现行海关法律体系可以发现,其在某种程度上也存在立法疏漏、立法理念、立法模式、立法冲突等问题。消解现行海关法律体系中的立法冲突等问题,需要顺应时代发展要求,更新立法模式,积极主动地参与国际海关立法,理论上也需要借助违宪审查等机制等来增强海关法律体系的统一性和系统性。
As a constituent part of China’s legal system,the customs legal system has a long and complete history.Viewing the relative problems encountered in shaping China’s customs legal system are somehow to find some problems existed in China’s legal system.Viewing China’s current customs legal system can find that there are also problems regarding legislation flaws,legislation ideals,legislation models,legislation conflicts etc.To tackle the above problems in China’s current customs legal system,we shall respond to the demand of the time,innovate the legislative model,more actively participate into the international customs legislation,and establish systems like constitutional review to strengthen the systematicness and unity of the customs legal system.
