Chasing the “Goddess” for 20 Years

'女神'的名字是'海关法学',它伴随我二十余年,我也追逐她二十余年。我初识海关法恰逢世界海关组织应贸易界的要求对《京都公约》进行修改,为减少贸易壁垒、促进贸易发展,公约内容上减少了许多刚性条款,增加了很多柔性规定,这也在2000年我国《海关法》修改中得到体现。与修法相适应的是,以往海关执法现象既没有人情味,也不文明,此后人类文明世界逐步达成共识,逐一查验逐渐被'红绿通道制度'所替代,严苛的'名捕'慢慢变成了温柔的'女神'。讲到海关法学这个'女神',在不同的人心目中可能有不同的归属。'女神'是中国的,还是世界的?我起初认识的'女神'是中国的,因为海关是一个国家主权的象征,海关法也是由一国海关立法的,海关是行政机关,海关法当然属于一国行政法的范围,而随着'一带一路'的拓展,中国'女神'走向世界,极有可能成为新版的世界'女神'。追逐'女神'异常辛苦,但国内和国际层面都在共同努力,通过建立海·关法学术机构、出版科研著作论文、建设海关专业学位点等,不懈致力于提升'女神'在知识体系和学科体系中的地位。

The name of the 'goddess' is 'Customs Law',which has accompanied me for more than two decades and I have been questing for' her' for the same length of time. My first acquaintance with the Customs Law coincides with the revision of the Kyoto Convention by the World Customs Organization at the request of the trade circles. In order to reduce trade barriers and promote trade intercourses, the Convention has reduced many rigid clauses and added a lot of flexible provisions.This is also manifested in the revision of China’s Customs Law in 2000.The enforcement of the Customs Law used to be impersonal and rude.Matching with the revision of law, people in the civilized world reached a consensus;one-by-one check was gradually replaced by the 'red and green channel system',and the draconian 'manhunter' slowly turned into a gentle ' goddess ' ' When it comes to the Customs Law, people may hold different views towards this' goddess '.Is the' goddess 'Chinese or international? At first,the' goddess'is Chinese,for customs symbols the sovereignty of a nation. Also,the Customs Law is also legislated by the customs of a country and customs is an administrative organ of a country,so the Customs Law surely belongs to its administrative law.However, with the advance of ' the Belt and Road' Initiatives,the Chinese 'goddess' is likely to appear in the world and become an international ' goddess'. The pursuit of 'goddess 'is extremely hard,but with joint and unswerving efforts of China and the international community,we are committed to promote the status of the 'goddess' in the systems of knowledge and disciplines by the establishment of the customs law academic institutions, publication of scientific research papers,the construction of customs professional degree,etc.
