我国夫妻约定财产制度研究

我国夫妻约定财产制度是与夫妻法定财产制度相对应的制度,与夫妻财产关系密切相关。它充分体现着意思自治原则,使夫妻双方更加具有独立平等的人格尊严,打破了传统的单一夫妻财产制度,给予夫妻之间更多更自由的财产处理方式,更有助于家庭的稳定与和谐。从我国夫妻约定财产制度的发展历程与他国的立法比较,我国该制度在效力、公示方式、变更与撤销以及与其他部门法之间的联系等方面都存在不足;在今后,还需进一步明确婚前财产与婚后财产的界限,在财产的变更与撤销方式上给予当事人更多的自由,从而使夫妻约定财产制发挥最大功效,为家庭稳定提供更加完善的立法保障。

China's marital agreed property system is corresponding with the legal marital property system,which is related to the marital property relation.It fully embodies the principle of will autonomy,making the couple have more independent and equal personal dignity,breaking the traditional single marital property system,giving more freedom to dispose of the property,which is helpful to the stability and harmony of the family.Compared with the developing process and the legislation in other countries,we have some shortcomings on the following aspect of the effect,publicity,change and cancellation as well as the insufficient connection with other departments.In future,we should further clarify the boundaries of premarital property and marital property,giving the parties more freedom in the property alteration and cancellation method,so as to maximize the effectiveness of marital property system and provide a more perfect legislation for a stable family.
