摘要
填海项目竣工海域使用验收测量已经是填海海域从海域转为陆地,向国土部门申请换发土地证前的一个规定程序,是落实海域法的重要保证,在国家海域和土地管理体系中具有重要的地位。自2002年《中华人民共和国海域使用管理法》颁布实施以来,国家海洋局颁发一系列配套法规文件及多部技术规范文件,建立起较为齐全的海域使用管理法规和技术体系,但仍存在管理办法不完善、技术规范缺乏、验收标准模糊等问题,文章就验收测量工作中的施测手段、界线判定方法以及面积量算中遇到的若干问题进行探讨,以期为国家海域使用管理提供参考。
The acceptance survey of reclamation projects has been an essential procedure before the ap-plication of land certificate from Land Department for confirming reclamation sea areas to land.It is an important guarantee to implement the Law of Sea Area Use and Management (LSAUM)and occupies im-portant position in sea area and land area management.Since the LSAUMwas promulgated in 2002,the State Oceanic Administration had published a series of legal documents as well as technical specification documents.However,there are still some remaining problems to be solved.In this paper,the author tried to present some issues including surveying methods,boundary determination and area measurement of reclamation projects as references for administering sea areas usage.
