海域立体确权可行性研究

海域是三维立体空间,包括水面、水体、海床和底土,多数海域使用是使用海域垂直方向的部分范围,对海域进行立体化确权管理是集约利用海域资源的必然趋势。文章从资源开发、经济发展及资源权利角度研究海域立体确权的意义,基于我国海域立体确权的现状,从海域权利特性、法律依据、海洋经济及海域管理等方面分析海域立体确权的可行性,并提出政策管理、技术体系等方面的建议。

Sea area is a three-dimensional space,including sea surface,sea water,seabed and subsoil.The usage of sea area in three-dimensional style is an inevitable trend for intensive utilization of ocean resources.This paper studied the significance of three-dimensional right from sea resources development,economic development and resources right angle.In addition,this paper analyzed the feasibility of three-dimensional sea area ownership,and put forward some policy suggestions such as management,technology system,based on the current situation,characteristics,legal basis,the right of marine economy and marine management characteristics of stereo sea right confirmation in China.
