Reflection on Legal Economics of China's New Railway Transportation Enterprise Network

我国铁路企业走向现代企业制度的改革刚刚起步 ,任重而道远。有许多理论问题亟待研究和探讨。本文以铁路法和公司法为基本立足点 ,运用法律经济学的研究方法 ,以“网运分离”为突破口 ,分析了我国铁路现行体制的弊端和改革的制约因素 ,提出以“网运分离”为基础 ,以公司制改造为蓝本 ,以建立产权明晰 ,权责明确 ,政企分开 ,管理科学的现代企业制度为目标的改革和制度创新建议。

China's railroad business enterprise is just in the initial stage in its system reform and there are still many problem to be studied. Base on enterprise Law and Railrord Law,and in terms of the research method of the law economics, the paper analyses the our system's irregularity of railroad operation and the restrictive reform factor in its reform,bring ups that the management of railroad network to should be separated from railway transportation.
