高校学生创业的立法规制

Legislative Regulation of College Students’ Entrepreneurship

高校学生在校读书期间,利用课余时间兼职创业是新兴的社会现象,对这些群体创业如何规制,仍然存在立法空白。我国促进创业的相关规定大多分散于《就业促进法》《中小企业促进法》《促进科技成果转化法》和其他相关法律、法规、规章中,这些规定太过原则化,执法中缺乏可操作性。当前,借鉴欧美发达国家关于促进创业的立法,在制定《创业促进法》的过程中应着重解决立法的原则和目的、创业融资的金融和财税支持、创业公共服务、高校创业教育的价值目标和评估体系、执法机构以及立法模式等方面的问题,从立法层面规范高校学生的创业行为,完善创业法律法规和政策措施,形成促进创业的长效机制。

That college students,when in school,use their spare time to do part-time entrepreneurship is a new social phenomenon.However,there is still a legislative gap concerning how to regulate their entrepreneurship.Most of the relevant provisions on promoting entrepreneurship in China are scattered in the Employment Promotion Law,the Small and Medium-Sized Enterprises Promotion Law,the Law on Promoting the Transformation of Scientific and Technological Achievements,and other relevant laws,regulations and rules.These provisions are too principled and lack of maneuverability in law enforcement.At present,drawing lessons from the legislation of the developed countries in Europe and America on promoting entrepreneurship,in the process of formulating the Entrepreneurship Promotion Law,we should focus on solving such problems as the principles and purposes of legislation,the financial and fiscal and tax support for entrepreneurship financing,the entrepreneurship public services,the value objectives and evaluation system of entrepreneurship education in colleges and universities,the law enforcement agencies and the legislative models,so as to standardize the entrepreneurial behavior of college students from the legislative level and improve laws,regulations,policies and measures,thereby promoting entrepreneurship and form a long-term mechanism to promote entrepreneurship.
