高校学生体育运动伤害事故处理和风险防范机制的研究

Injury Accident Treatment and Risk Prevention Mechanism of College Students' Sports Activities

采用文献资料法等研究方法,对高校学生体育运动伤害事故处理和风险防范现状进行了分析,阐述了事故处理和风险防范机制的指导思想、事故的概念以及赔偿对象和赔偿范围,论述了事故处理机制中责任认定、责任归责、责任承担与赔偿、责任赔偿金、申诉等的法律法规依据、主体特征和处理原则,叙述了事故风险防范机制中加强宣传教育提升安全知识和风险防范意识,完善风险防范制度,购买事故商业险的内容、措施、方式方法,总结出学生体育运动伤害事故及其纠纷是干扰高校体育工作的重要因素之一,必须高度重视并依法依规建立事故处理和风险防范机制,拓展社会资源支持学校体育工作的渠道,从建机构、立制度等顶层设计做起,保障事故及其纠纷能够得到妥善处置的结论,并据此提出相应建议,为深化高校体育改革服务.

Using scientific research methods,such as literature review,first analyzed the current situation of university student sports injury accident treatment and risk prevention,and explained the guiding ideology,the concept of the accident,the object and scope of compensation,then discussed the related laws and regulations,characteristics and principles of treatment as to responsibility identification,responsibility and compensation,liability compensation and appeal in handling the accident. Secondly described relevant methods and measures,such as promoting safety knowledge and risk awareness,improving the system of risk prevention,buying accident insurance and so on. Finally,summed up that student sports injury accident and dispute is one of the important interference factors that trouble the implement of university sports,and it is advised to attach great importance to this work,establish the mechanism of injury accident treatment and risk prevention for college students by laws and regulations,expand the channels of social resources to support the school sports work,and accordingly put forward the corresponding suggestion to make contributions to the deepening reform of college sports.
