政府权力清单制度实证研究

An Empirical Study of the System of the Governmental Power List

我国正处在社会转型的过渡期,解决计划经济时代遗留下来的行政权力泛滥的问题,已成为我国社会经济发展的当务之急。为了规范政府行政权力的运行,我国陆续公布了《行政诉讼法》、《行政处罚法》、《行政许可法》、《行政强制法》等法律法规。自2008年的《政府信息公开条例》开始,中央政府开始着重展开对行政机关权力的清算工作。十八届三中全会后,全国各地陆续开始建立权力清单制度,以期望通过公开政府权力清单,强化社会监督,推动建设廉洁高效的服务型政府。

As our country is now in the transition period of social transformation,a solution to the excessive administrative power left over by the planned economy era has become the top priority of social and economic development in our country. In order to standardize the operation of the government administrative power,our country has successively enacted laws and regulations such as The Administrative Procedure Law,The Administrative Penalties Law,The Administrative Permission Law,and The Administrative Compulsory Law. Since the issuance of Regulations on Open Government Information in 2008,the central government has set to liquidate the power of administrative organizations. Since the third plenary session of the 18 th Party Congress,efforts have been made to establish in succession the power list system nationwide so as to strengthen social supervision and to promote the construction of a clean and efficient service-oriented government by virtue of disclosing the governmental power list.
