Analysis of Legal Validity of Fake Marriage

假结婚在现实生活中已不再是个陌生的词汇,在法律的外衣下,隐藏着形形色色的假结婚,但同时,它的出现也并非风平浪静,当后续的矛盾纠纷纷至沓来之时,才让当事人以及司法人员察觉出它的隐患。而我国现行的婚姻法并没有对这一现象进行规定和限制,这给司法实践带来了一些难题,因此有必要在分析假结婚现象的基础上,通过法理分析,结合比较法上的借鉴,对假结婚现象的效力分情形进行研讨,并对假结婚的规制提出一些建议,以期对立法和司法实践提出自己的建议。

The false marriage is no longer a strange word in our real life .There are so kinds of false marria-ges under the guise of law.At the same time,it has also not been in the smooth water and only after con-tradictions and disputes coming in a throng that the parties and the judicial personnel then realize its risks. But the current marriage law in China has no regulations and restrictions for this phenomenon which brings some difficulties to the judicial practice.So it is necessary to discuss about this question through theoretical analysis and combination with the comparison of the force to the foreign countries on the basis of the anal-ysis of the phenomenon of false marriage.Then putting forward to some suggestions on the regulation of false marriage in order to put forward to my own suggestions on legislation and judicial practice.
