馆藏不同历史时期土地契约文书的整理与研究

The Sorting and Study of Land Contracts from Different Historical Periods in the Collection of Hunan Provincial Museum

契约是人类社会发展到一定时期的产物。湘博藏有一批晚清至民国时期的土地契约,分为卖屋基、卖阴地、卖山地、卖耕田、涉及田产分配的分家契约、耕田租种的发佃契约等类别。本文按契约类型进行整理,并对契约订立的原因进行初步的分析。

Contracts are the products of the human society when it reached a certain stage.Hunan Provincial Museum has a number of land contracts of the period from late Qing Dynasty to the Republican Era,which fall into the categories of contracts concerning the sale of house foundation land,graveyard,farmland and mountainous land,contracts concerning dividing up family property that involved the distribution of land property,and contracts concerning the tenancy of land.This paper analyzes these contracts according to the reasons of drafting them.
