终身监禁制度是附属于死缓的刑罚措施,认为终身监禁制度的确立使得贪污受贿犯罪的处罚得以从宽的观点是值得商榷的。终身监禁型死缓的刑罚强度比死刑立即执行轻,比普通死缓重。终身监禁制度是一种针对贪污受贿犯罪新增的死刑措施,而不是死刑立即执行的替代措施。终身监禁制度是基于弥补贪污受贿犯罪刑罚力度上的空当而确立的。终身监禁制度的确立使得贪污受贿犯罪的刑罚变得更加严厉。

The system of life imprisonment in our country is attached to death penalty with suspended execution.The view that the establishment of the system of life imprisonment makes the punishment of the crimes of embezzlement and accepting bribes more lenient is debatable.In terms of the severity of the punishment,life imprisonment is lighter than death penalty with immediate execution and heavier than death penalty with suspended execution.Life imprisonment is a new measure of death penalty of the crimes of embezzlement and accepting bribes,not an alternative to death penalty with immediate execution of the crimes.The system of life imprisonment is established to make up for the gap existing in the punishment of the crimes of embezzlement and accepting bribes.The establishment of the system of life imprisonment has made the penalty of the crimes of embezzlement and accepting bribes more severe.
