A Study on the Trial of Non-governmental Lending Cases——Take XIA's Series of Cases as an Example

民间借贷合同成立及生效认定情形的繁杂性,民间借贷本金及利息处理结果的迥异性,使实践中民间借贷纠纷处理出现同案不同处理的情况。只有将司法实践与法学理论相结合,在方法上由个别上升到一般,再由一般回归到个别来寻求民间借贷案件审理中的相应对策,以期民间借贷纠纷规范有序解决。

The complexity of the establishment and validity of private lending contracts and the different results of the principal and interest treatment of private lending make the dispute settlement of private lending appear different cases in practice. Only by combining judicial practice with legal theory, can the methods be raised from individual to general, and then returned from general to individual to seek the corresponding countermeasures in the trial of private lending cases, in order to solve the disputes of private lending in a standardized and orderly manner.
