社区矫正立法若干重大问题探究——基于对《社区矫正法(草案)》的评价与修正建议

Research on Several Major Issues of Community Correction Legislation——Based on the Evaluation and Correctional Recommendation of the Community Correction Law (Draft)

《社区矫正法(草案)》于2019年6月25日提请全国人大常委会审议,7月5日在全国人大网公开征求意见。《社区矫正法(草案)》存在社区矫正性质规定不明确,关于社区矫正任务的规定存在缺项,没有设置专章对社区矫正机构进行明确规定,社区矫正执法人员没有赋予人民警察身份和必要的强制执行权等问题。针对这些问题,应进一步规范和完善,使社区矫正制度从法律意义上更加规范。

The Community Correction Law(Draft)was submitted to the NPC Standing Committee for consideration on June 25,2019.On July 5,it solicited opinions on the National People’s Congress Network.There are some problems in the Community Correction Law(Draft),such as the provisionsof nature and task to community correctionis not clear,lack of specific chapters on community correction agencies,community correction law enforcementpersonnel have not been given the identity of the people’s police and the necessary enforcement power.In view of these problems,community correction should be further standardized and improved to make it more standardized in the legal sense.
