鉴定意见的科学性、可靠性使其在庭审中发挥了重要作用,但同时存在着鉴定材料未质证、鉴定人出庭无问题清单、鉴定标准缺失、专家辅助人出庭少等影响鉴定意见科学性、可靠性的问题,致使鉴定意见质证出现困境,进而使其采纳颇具争议。为解决质证困境和争议,应建立鉴定材料签字移送制度,落实以问题清单为基础的交叉询问;加快司法鉴定标准化委员会建设,迅速制定实践中缺乏的标准;建立专家辅助人数据库,通过准入、退出机制实现动态监管。

The science and reliability of the expertopinions have played an important role in the trial.At the same time,there are some issues that affect the science and reliability of theexpert opinions,such as the lack of cross-examination of the expertmaterials,not prepare a list of questions for expert appearing in court,the lack of expert standards,and the lack of expert assistants appearing in court.In order to solve the dilemma and disputes of the cross-examination,establish a signature transfer system for identification materials,implement cross-examination based on the list of issues,speed up the construction of the judicial expertise standardization committee,quickly formulate standards that are lacking in practice,establish the database of expert assistants,and realize dynamic supervision through access and exit mechanism.
