摘要
我国现行职务犯罪侦查程序制度中存在立案前调查缺乏法律保障、侦查程序与庭审程序冲突、对犯罪嫌疑人以作证为条件换取某种法律上有利于自己的结果的情况处理不规范、侦查中对犯罪嫌疑人强制措施的司法审查缺位、特殊侦查行为缺乏立法认可、犯罪嫌疑人权利仍缺乏保障等缺陷。解决这些问题,应从建立与庭审程序相适应的双轨制侦查制度,建立与职务犯罪相适用的证据采集制度,建立与国际相统一的犯罪嫌疑人人权保障机制,建立侦查监督的实施制度,完善相关配套制度等方面入手。
There are a series of shortcomings in China’s current procedure system of investigating job-related crimes. To solve these problems, we should start from establishing two-detection system, evidence collection system, criminal suspects mechanism for the protection of human rights, and implementation system of investigation and supervision as well as improving relevant supporting systems.
