摘要
具备作品构成要件的广告语应可成为著作权的客体,这符合著作权法的立法精神。除著作权法外,商标法可对符合商标构成要件的广告语进行更有效保护。广告语征集广告并非悬赏广告,而是一般合同缔结中的要约或要约邀请。
The advertisement words containing the elements are possible to become the objects of copyright, which conforms to the spirit of copyright legislation. Besides the copyright law, the trademark law sometimes can protect the advertisement words more effectively. An advertisement of advertisement words collection is not an advertisement offering a reward, but an offer or an invitation of offer in a common contract.
