摘要
确认业主身份要以房产证、不动产登记簿、售房合同、结婚证以及其他合法有效的法律文件等为客观依据,并须根据具体情况进行判断。房屋所有权证持有人及其配偶、房屋买卖合同中记载的购房人及其配偶、房屋所有权人的合法继承人应当依法认定为业主,而开发商、物业使用人、房屋抵押权人、实际出资人等,不宜认定为业主。
To confirm the owner status, it is a must to take the real estate evaluator, the real estate registration book, the selling houses contract, the marriage certificate as well as other legitimate effective legal documents and so on as the objective basis. We must act according to the special details to carry on the judgment. The house property rights card possessor and the spouse, the house buyer and the spouse who record in the house contract of sales, the house owner’s rightful heir must be recognized legally as the owner, but the developer, the property commuter, the house mortgagee, the actual member and so on, are not suitable to recognize as the owner.
