确认业主身份要以房产证、不动产登记簿、售房合同、结婚证以及其他合法有效的法律文件等为客观依据,并须根据具体情况进行判断。房屋所有权证持有人及其配偶、房屋买卖合同中记载的购房人及其配偶、房屋所有权人的合法继承人应当依法认定为业主,而开发商、物业使用人、房屋抵押权人、实际出资人等,不宜认定为业主。
