试论我国小额诉讼程序的建构

On China’s Construction of Small-claims Procedures

随着我国法治建设的推进,公民诉讼意识的增强,社会上出现了越来越多的小额诉讼。如何更好地解决这些纠纷已经引起了社会的广泛关注。鉴于世界司法改革的趋势主要是程序的简易化,小额诉讼程序自身又具有特殊的独立适用的程序价值,且与我国目前的司法状况相吻合,我国应该接受并确立小额诉讼程序。

With the propelling of China’s legal construction and the enhancement of civil awareness of litigation,more and more small claims have been appeared in the society.How to resolve these disputes to the best advantage has aroused widespread social concern.China should accept and construct small-claims procedures since the world’s trend of judicial reform is to simplify the process,small-claims procedures themselves have a special and independently applied process value,and they are conformed to China’s current judicial situations.
