The Research of the Relationship Between the Media Supervision and the Criminal Trial

在刑事审判领域改革以及媒体形态发展的背景下,媒体介入刑事审判活动的广度及深度逐渐扩大。媒体通过对刑事审判活动的报道帮助社会公众实现了舆论监督的权利,促进了刑事审判活动的公开与透明,然而媒体的不当报道及评论亦损害了审判的独立性、司法的权威性。因此,探讨媒体监督与刑事审判之间的关系,挖掘媒体监督刑事审判背后的矛盾根源,推进媒体监督与刑事审判关系的良性发展尤为必要。

With the reform in the field of criminal trial in China and the development of the form of the media,the media plays as an important carrier and its intervention in the breadth and depth criminal justice activities is gradually expanding.By reporting criminal trial activities,the media helps the public realize the rights of public supervision,which to some extent,has promoted the publicity and transparency of criminal trial activities and the realization of judicial justice.However,inappropriate media reports and comments also damaged the independence of the trial,the judicial authority.By discussing the media supervision and the relationship between the criminal trial,digging the root contradiction behind the media supervision to criminal trial,to promote the virtuous development of the relationship between media supervision and criminal justice.
