摘要 "互联网+交通"的兴起为消费者提供了一种新型出行方式——网约车。关于私家车接入网约车平台是否合法等问题伴随着该业态发展的始终。近日《网络预约出租汽车经营服务管理暂行办法》的出台,确认了网约车的合法性,明确规定私家车符合法定条件可接入平台参与运营。立法的这一选择,背后有诸多理论与现实的考量因素。综合运用法经济学中利益衡量理论、成本收益理论等分析方式,解构这一制度选择的合理性,并对可能出现的问题进行预判,将助益于私家车接入网约车平台提供出行服务的良性发展。 The emergence and development of 'Internet + Traffic'provides a new way to the online-arranged taxis.There has been a lot of debate over whether private cars accessing to online taxibooking service platform should be made legal.Recently,the issue of the Interim Administrative Measures for the Business of Online Taxi-Booking Services and the legalization of online-arranged taxis no doubt have great importance and will produce profound influence on the reform of travel mode.There are many theoretical and practical considerations behind the choice of legislation.By using the interest-measuring method and the cost-benefit theory in Law and Economics,the rationality and feasibility of institution choice is analyzed,which is favorable to unify the parties' understanding,and promote the healthy development of the online-arranged taxi industry.
