论行政奖励的形式及其法制化——基于市场经济社会的法律思考

On the form of Administrative Awards and Its Legal System——Legal Thinking Based on Market Economy Society

行政奖励的形式是行政奖励行为的外在表现形式,其对研究行政奖励行为有着重要的意义。我国传统的行政奖励的形式是建立在计划经济基础之上的,随着市场经济的发展,行政奖励形式的内容、原则理念和结构都发生了显著的变化,权能奖励等现代市场经济社会的新型形式不断出现。但由于立法的缺位以及理论研究上的空泛,当前实践中行政奖励的形式具有很大的随意性,甚至还出现了某些方面的负效应。因此,行政奖励的形式亟待法制化。

The form of administrative awards is the external manifestation of the administrative reward,which is of great significance to the study of the administrative reward.Along with the development of market economy,the content of the form of administrative rewards,the principle of the concept and structure changed and the new form of the modern market economy society appeared,such as power and reward,etc.Due to the absence of legislation and vague of theoretical research,practice of the administrative reward has great randomness currently,even some aspects of the negative effect.Therefore,the form of administrative reward incentives to be legalized.
