政务信息资源的权属界定研究

随着电子政务云平台建设的推进,政务信息资源共享开放的技术障碍逐步消失,法律制度的缺位成为其主要的制约因素,尤其是信息资源的权属问题上。国家和地方层面正朝向确立政务信息资源国家所有权的方向探索。在此立法形成过程中,为减少信息社会中信息分布不均匀所引起的不平等现象,需要明确国家所有权是与私人所有权具有本质区别的财产权制度,公众接近是其本质特征。同时,为平衡数据利用与个人隐私保护之间的冲突,需区分政务信息资源的共享与开放开发的不同场景。

With the advancement of e-government cloud platform construction,the technical barriers to the opening and sharing of government information resources have gradually disappeared,and the absence of legal systems has become its major constraint factors,especially the ownership of information resources. At the national and local levels,we are exploring the direction of establishing national ownership of government information resources. In order to reduce the inequality caused by the uneven distribution of information in the information society,it is necessary to clarify that the state ownership is a property right system that is essentially different from private ownership in the process of forming the legislation. Public access is its essential feature. At the same time,in order to balance the conflict between data use and personal privacy protection,it is necessary to distinguish between different situations of sharing and open development of government information resources.
