摘要
自2010年以来,为了抑制日益高涨的房价,我国中央和地方政府陆续出台了一系列房屋限购政策,作为中部H省省会所在地的C市也不例外。为了抑制投机炒房行为,C市于2017年3月18日起先后出台了三个住房限购令。但是,依据该省的行政程序规定和规范性文件管理办法,C市三个住房限购令存在一系列程序性瑕疵,比如缺少草案公布程序、缺乏专家咨询论证程序、未举行听证程序、公众参与程序不足以及合法性审查程序落实不到位等。
The central and local governments have launched a series of House-Purchasing Limitation Orders to curb rising house prices since 2010 including the city of C. The city of C as the capital of H Province launched three House-Purchasing Limitation Orders to restrain speculation of the real estate since March 18 th,2017. However,according to the Administrative Procedure Provisions and the Administrative Regulations of Normative Documents of the H Province,there are a series of procedural restrictions on the three house-purchasing limitation orders in the city of C. For example,the absence of the draft announcement procedure,the expert consultation procedure and the hearing procedure; moreover,the insufficiency of public participation procedure as well as the inappropriate implementation of the legality examination procedure.
