哲学是一种系统化、理论化的世界观和方法论,科学的犯罪构成的立法设置与科学的犯罪构成理论的建构需要哲学的世界观和方法论的引导。马克思主义哲学是科学的、开放的和发展的哲学。犯罪构成的建构应在马克思主义哲学基本原理指导下展开,同时,可借鉴一些合理的西方哲学思想和方法。辩证唯物主义的"物质决定意识""分析和综合""系统和要素""结构与功能""运动与静止""对立统一""量变与质变"等哲学原理,以及西方哲学中的"价值哲学""结构主义""过程哲学""实用主义哲学"等哲学理论对于犯罪构成的建构具有重要的指导作用。在哲学理论审视下,我国通说四要件犯罪构成理论体系具有一定的合理性,但是,它也存在着一定的缺陷。在未来,我国犯罪构成理论体系应在哲学理论指导下予以进一步完善。

Philosophy is a kind of the world outlook and methodology of systematization and theorization. When we construct the constitution of crimes in legislation and the theory of constitution of crime,we need the guide of the world outlook and methodology of philosophy. The philosophy of Marxism is a kind of open developing scientific philosophy. There are many rational theories of philosophy in the treasure house of western philosophy. When we construct the constitution of crimes in legislation and theory,we need the guide of theory of philosophy of Marxism and some rational theories of western philosophy. The intimate theory of the philosophy of Marxism (dialectical materialism)include ‘analysis and synthesis ’‘system and element’‘structure and function’‘motion and motionlessness’ ‘the law of the unity of opposites’ ‘the law of quantitative and qualitative change’,and so on. The intimate theory of western philosophy include axiology structuralism,ontology of phenomenology,process philosophy,pragmatism,and so on. If we examine the theory of constitution of crimes,by using the theory of philosophy,we will find that our universal system of theory of constitution of crimes is rational mainly,but it still has some defects too. In future,we need the guide of philosophy to perfect the universal system of theory of constitution of crimes in our country.
