摘要
诱惑侦查是一把双刃剑,合理界定诱惑侦查的适用范围是有效构建诱惑侦查规范适用的重要组成部分。对于诱惑侦查适用范围的确立,理论界在是否必须以严重社会危害性案件为前提、是否应当局限于无被害人案件、是否禁止政治性和职务性犯罪案件、是否限定于具体与特定的犯罪案件类型等方面还存在着分歧。以中国裁判文书网的案件判决为视角,总结出诱惑侦查适用范围在实务中的特点后,发现诱惑侦查的适用范围有着扩张性、随意性和混乱性等实践问题。法律规范的模糊、司法理念的滞后、理论学界的争议是实践中诱惑侦查适用范围无序现状产生的根源。在当前的法治现状和司法环境下,通过立法来严格明确诱惑侦查的适用条件,颁布相关司法解释来将诱惑侦查适用范围界定为具体、特定的犯罪类型是实现诱惑侦查有限适用的现实之道。
Temptation investigation is a double-edged sword. To rationally define the application scope of temptation investigation is an important part of effective construction of standard application of temptation investigation. As to the establishment of the application scope of temptation investigation,the theoretical circle remains divided on whether'serious social harm case'must be the premise,whether it should confine to ' no victim case',whether it should exclude political and abuseof-power criminal cases,or whether it should be limited to specific crime cases. From the perspective of the judgement of cases on Chinese Judicial Document Network,this paper summarized the practical characteristics of the application scope of temptation investigation in practice. It then found that the applicable scope of seduction investigation has some practical problems such as expansionism,randomness and confusion. At root for the disorder of application scope of temptation investigation in practice are the vagueness of legal norms,the lag of judicial idea and the dispute in the academic circle. In the current legal and judicial environment,it is feasible to realize the limited application of temptation investigation by introducing legislation to strictly define the application scope of temptation investigation and issuing relevant judicial interpretation to limit the scope to certain specific types of crime.
