摘要
新《婚姻法》增设的离婚损害赔偿制度实施至今已有5年时间,但该制度的运行状况并不尽如人意,原因在于立法对该制度的规定过于疏漏,缺乏可操作性。针对该制度实施过程中凸现的几个问题的完善提出了粗浅意见。
It has been 5 years since the implementation of the divorce damage compensate system,but it still has many problems.The main problem is the oversight stipulation and lack of operation.This article gives some suggestions for the perfect of this system.
