散论理解儒学与法治融构的角度与前提

On the Premises of the Understanding of a Positive Interaction between the Confucianism and the Rule of Law

摘要 本文试图从尽可能宽泛的角度,来窥探以儒学为代表的中国传统文化,与法治社会融构的可能性,以及理解此种融构的心理前提。主要是自文化立场来阐述,更大程度上则是对于转变相关研究思路的一种呼吁,亦即:什么是传统文化的真核心,如何体悟儒家传统的真义,以及在何种层面上吾国传统可以融合于法治社会,并发生良性的作用。笔者认为,此实为一切讨论传统与现代问题之根本前提。其中,尤主张以践行为基,并以中、仁及人本主义为基调,作为建构中国法治的精神内核。 This essay tries to illustrate the premises of the understanding of a positive interaction between Chinese traditional culture,which is represented by the Confucianism,and the rule of law in China. This essay focuses few on the imperial legal systems but on how to shift our fixed mind in the relevant researches. Special approaches are applied by answering such questions:What is the true core of Chinese traditional culture? Why we misunderstand them? How to touch the heart of this culture? This essay concludes that the crucial concepts of Confucianism,such as Mean and Benevolence,do have common traits with the West jurisprudence,e.g.justice,balance and tolerance,which may dramatically function to promote rule of law in China's Mainland.
