中美判决书之介入资源对比研究

A Contrastive Study of Engagement Resources between Chinese and American Judgments

摘要 该研究以Martin和White等人提出的评价理论中的多声介入系统为理论框架,对比分析中美判决书中的介入资源,旨在探讨两国法官在判决书的撰写中采用介入资源所实现的人际功能,总结中美判决书各自彰显法律公正和实现司法权威的形式。研究表明:中国判决书倾向于使用对话收缩资源,以体现其权威性;而美国判决书更多地利用对话扩展资源,体现对听众/读者声音的兼容,以表明其公正性。 The present paper, in the framework of Engagement under Appraisal Theory put forward by Martin and White, makes a contrastive study of American and Chinese court judgments to investigate the similarities and differences between the two in us?ing the Engagement resources to realize their interpersonal function. It is found out that the Chinese judgment is inclined to use dialogue contractive resources to claim an authoritative stance; while the American judgment prefers dialogic expansive resources to realize its impartiality, which shows more tolerance to listeners’/readers’voices.
