近代法制文書詞語“知在”考

An Investigation Of Zhizai In Legal Documents of Modern Times

近代法制文書中習見'知在'一詞,元代雖有學者對其進行解釋,但語焉不詳,當代辭書均未收録。現通過對相關文獻考察與分析,認爲'知在'本義指知道'知在對象'所在地方,引申可指掌握情況,監管;在近代法制文書中表示一種與現代'取保候審'制度相近的監管制度,但二者又有一定的區别。

Zhizai is widely used in legal documents of modern times.Though scholars in Yuan Dynasty interpreted Zhizai generally,the definition of Zhizai finds no existence in modern dictionaries.According to the analysis of concerning bibliographies,the meaning of Zhizai is knowing the location,which is extended as knowing about the situation.Supervision,a similar system to guaranteed pending trial in legal documents ofmodern times,has its own features.
