正当防卫行为的客观期望效用分析

An Analysis of the Objective Expected Utility of Justifiable Defense Behavior

国内关于正当防卫制度的争论方兴未艾,周光权秉持行为无价值论,而张明楷认定结果无价值论,然而却从未有过从经济学的角度观察分析正当防卫的尝试,从此视角使用客观期望效用理论分析正当防卫行为,进而得出结论,即判定正当防卫时割裂行为和结果的行为无价值论和结果无价值论确实值得商榷,事实上当事人的正当防卫行为决策面对的是不确定的结果,不应该在事后割裂行为与结果之间的联系,而不适当的适用正当防卫制度会造成攀比奢靡的社会风气和社会底层普遍缺乏安全感。

Domestic debate on legitimate defense system is in the ascendant. Zhou Guangquan upholds the theory of behavioral worthlessness,while Zhang Mingkai holds that the result is worthless. However,there have never been attempts to analyze justifiable defence from an economic point of view. From this point of view,this paper uses the theory of objective expected utility to analyze justifiable defense behavior,and then comes to the conclusion that it is really worth discussing the theory of behavioral and consequence valuelessness in judging the split behavior and consequence valuelessness in justifiable defense. In fact,the decision-making of the legitimate defensive actions of the parties is confronted with uncertain results,and the relationship between the actions and the results should not be separated afterwards,while the improper application of legitimate defense system will lead to the extravagant social atmosphere and the general lack of security at the bottom of society.
