摘要
在大数据场景下,传统隐私权保护模式存在保护范围不及且能力不达的困境。从隐私权保护模式相关理论中抽丝剥茧,大数据场景下的隐私权核心是个人信息。本文以个人信息保护为主线,通过对比欧洲综合规制模式和美国市场自律规制模式,为我国隐私权保护寻找切实可行的出路。我国隐私权保护可综合借鉴德国模式和美国模式的有效方式,以人格尊严和人身自由保护为宗旨,建议立法回应大数据视角下市场需要与隐私利益的复杂关系,全面保护个人信息的人格利益和财产利益。
In the big data scene,the traditional privacy protection model has the dilemma of lack of protection and ability. From the relevant theories of privacy protection model,the core of privacy under the big data scene is the personal information. This article focuses on personal information protection,and compares the European comprehensive regulation model with the US market self-regulation model to find a practical way for China. China’s privacy protection can draw on the effective methods of German model and American model,with the purpose of personal dignity and personal freedom protection. It is recommended that legislation should respond to the complex relationship between market needs and privacy interests from the perspective of big data,and fully protect the personal interests of personal information and property interests.
