农民土地权益的利益结构与利益机制研究——基于农村社区的发展

Research on the Interests Structure and Interests Mechanism of Peasants' Land Rights and Interests——Based on the Development of Rural Community

农民土地权益保障核心在于农民土地利益的实现与发展,进而需完善农民土地权益的利益结构与利益机制。基于农村社区发展的视角,从农民土地权益的利益代表和利益表达、利益产生和利益分配、利益协调和利益保障、利益发展和利益共享等方面,构建农民土地权益的利益结构。在分析农户禀赋、农地流转风险、土地利益相关者、农村制度环境等农村社区发展要素对农民土地权益影响的基础上,创新农民培育、风险防范、纠纷解决、制度保障,构建农民土地权益的利益机制,使农民的土地权益得到保障,以推进农村社区的发展。

Achieving peasants' land interests is essential to the protection of peasants' land rights and interests,which needs the improvement of the structure and mechanism of peasants' land rights and interests.Based on the perspective of rural community development,this paper probed into the deputation,expression,producing,distribution,coordination,indemnification,development and sharing of peasants' land interests.Based on analyzing the impact on peasants' land right on part of the peasants' endowment,rural land transfer risk,land stakeholders,institutional and environmental factors,this paper proposed to nurture peasants' cooperative organization,strengthen the mechanism of risk prevention,promote dispute solution,and establish the guarantee mechanism so as to realize and protect the peasants' land rights and interests to promote the development of rural community.
