专利权是当代世界进入知识经济时代的“游戏规则”之一 ,在市场竞争机制中 ,对专利权保护的基本要求是平衡专利权人与相关权利人的利益 ,界定专利权与平等竞争权的范围。这是确定专利法与经济法的依据。

Patent right is likened to one of the game regulations in the epoch of intellectual economy.Over-strict or over-loose regulation of patent efficacy will be the obstacle to social and economic development.This paper analyses the actual situation in the three aspects:1)the basic requirements of patent protection,2)the interest balance batween the patentees and their opposite parties concerned,3)the extent of patent validity and responsibility principles.The aim is to seek the basis for the scientific regulation of the relations between the patent right and the equal competition right,between the patent law and the law of economy.
