行政听证主持人地位独立刍议

程序中立是程序正义的基本要求之一 ,其最主要的问题是裁判者的地位独立。听证主持人只有中立 ,才能不偏不倚地主持听证和做出决定 ,从而促进权力公正运作 ,保护行政相对人的权利。我国法律尚未规定听证主持人独立的法律地位 ,本文拟就此提出一些完善之策。

Procedural impartiality is one of the reqirements of procedural justice,and its main problem is the impartiality of the judge.Only if the president of administrative hearing is impartial,he can manage the hearing and bring in his award,encouraging the operation of power and protecting the rights of private party in the adminsstrative process In our country,the law never enacts the impartiality of the president of administrative hearing,so the author tride to make out some measures to perfect it.
