走私罪的有关问题研究

新刑法典对走私罪的规定 ,无疑有很大的进步 ,为严厉打击走私犯罪提供了法律依据。但是 ,随着研究的深入和实际情况的变化 ,立法和实践中逐渐暴露出一些问题 ,因此应从立法技术和刑法理论的角度对走私罪的有关问题作进一步的探讨 ,以期有助于司法实践中对走私罪的正确定罪量刑。

It's a great improvement that the new criminal law has a new stipulation for smuggling crimes,which provides the law basis for severe attack on smuggling.But,with the develpment of realities,some problems have gradually emerged.The author offers some opinions on legislation from the angle of legislation technique and criminal theory,in order to benefit the justice.
