本文从四个方面分析了行政程序具有独立价值的法理学原因 :行政程序首先是一个过程 ,而不是手段或形式 ;实体正义通过行政程序来获得和体现。行政程序的既定力效应限制了行政权力的恣意和滥用 ,程序正义的理论也论证了行政程序独立价值的存在。

The paper explains the legal basis for the independent value of adminstrative procedure from four aspects, that is, firstly, adminstrative procedure is a process rather than a kind of measure or form; secondly, the justice of the object is achieved and embodied through adminstrative procedures; thirdly, the given power of adminstrative procedures prevents the acminstrative power being abused; finally, the theory on procedure justice proved the existance of the independent value of adminstrative procedures.
