摘要
客体错误是刑法错误中最复杂的问题,必须通过抽象思维才能认识而不能为行为人所直接感知,必须通过理论上的研究才能做出科学的概括而极少从刑法条文上看到它的规定。用理论与实践相结合的方法,可以对其范围、种类及其罪责认定等问题予以澄清。
The error of the object is the most complicated problem in the theory of criminal error. By combining the theory with the practice, the author studies the error of the object in scope, sorts and responsibility for an offence. More efforts are made to work out the dividing line between the error of the object and the objective of a crime.
